Terms & Conditions


Motorcycles can be dangerous if not properly maintained and ridden safely. Thomason Performance has no control over the usage of any of it's parts. Thomason Performance expects the dealer and dealer's customer to exercise good judgement as to the proper selection, installation, use and maintanance of any parts. Thomason Performance assumes no responsibility for damage or injury of any kind, because of the misuse or improper application of any parts in any way by any person. Thomason Performance expects the end user to exercise good judgement.


Force Majeure: Thomason Performance shall be excused from the performance of any obligation of Thomason Performance hereunder during and for so long as its performance is prevented by Acts of God, weather conditions, war or other national emergency, active terrorism or terrorist threat, civil disturbance, strikes or labor disputes involving Thomason Performance or any of its contractors, suppliers, or vendors, unavailability of materials or labor, shortage of materials, labor or transportation, delays in delivery of products or materials by its contractors, suppliers, or vendors, or the orders or directives of any court or government agency.


Applicable Law: All disputes, controversies, or differences arising in connection with the validity, execution, performance, breach, termination, and enforcement of any sales or service contract with Thomason Performance and these Terms and Conditions shall be governed and construed in accordance with the laws of the state of New Hampshire.


Applicable Forum: Subject to the Agreement to Arbitrate below, all legal proceedings, including arbitration as well as any court proceeding involving any disputes, controversies, or differences arising in connection with the validity, execution, performance, breach, termination, and enforcement of any sales or service contract with Thomason Performance and these Terms and Conditions shall be filed and held in the state of New Hampshire.


Agreement to Arbitrate: All disputes, controversies, or differences arising in connection with the validity, execution, performance, breach, termination, and enforcement of any sales or service contract with Thomason Performance and these Terms and Conditions, as well as any injuries, costs, damages, claims, or expenses arising in connection therewith, including whether or not the dispute or claim is arbitrable, shall be finally settled in an arbitration proceeding under the Rules of the American Arbitration Association in effect at the time a demand for arbitration under the rules is made. Purchaser expressly waives trial by jury. Selection of the arbitrators shall be as follows: Either party may, by written notice to the other within 30 days after a controversy has arisen that is subject to this agreement, appoint an arbitrator who shall be an attorney or judge who is in good standing as a member of the New Hampshire Bar. The other party shall, by written notice, within 30 days after receipt of such notice by the first party, appoint a second arbitrator who shall likewise be an attorney or judge who is in good standing as a member of the New Hampshire Bar, and in default of such second appointment the first arbitrator appointed shall be sole arbitrator. When two arbitrators have been appointed as provided for above, they shall within 20 days appoint a third arbitrator who shall serve as chairman. If a chairman is not appointed within 20 days by the existing two arbitrators, the parties will apply to the American Arbitration Association for appointment of the third arbitrator. The parties agree to be bound by the findings of the arbitration, including the determination and amount of any damages suffered, and such findings shall be binding on their heirs, executors, administrators, successors and assigns. Each party will bear that party's own expenses in the arbitration proceedings for arbitrators' fees and attorney fees, for that party's witnesses, for records and transcripts, and other expenses of presenting the case. Notwithstanding the foregoing, the courts shall have exclusive jurisdiction over injunctive or provisional relief pending arbitration. The arbitrators shall not be empowered to award punitive damages to any party. A judgment on the award rendered may be entered in any court having jurisdiction.


Limited Warranty: Thomason Performance products have a one year limited warranty from the Thomason Performance date of invoice against all material or workmanship defects. If, due to such a defect, you return the product to us within the warranty period, we will replace it or, at our option, repair it at no charge to you, but for the cost of labor for which Thomason Performance is not responsible.


Production Delays Due To Suppliers: Purchaser acknowledges that the timeliness of Thomason Performance's services and products herein are dependent upon the timeliness, speed, and schedules of its respective suppliers in providing materials necessary for said services and products. In no event, whether as a result of breach of contract, warranty, tort, or otherwise, shall Thomason Performance be liable for any consequential, incidental, special, or punitive damages, including but not limited to, loss of profit, loss of revenues, costs of delay, down time costs, storage fees, loss of products or equipment, cost of capital, cost of substitute products, costs of rental of temporary equipment, facilities or services, or cost of replacement or substitute equipment, facilities, or services. In no event shall Thomason Performance’s liability to the Purchaser for any loss or damage arising out of, or resulting from this Agreement or from its performance or breach, or from the products or services furnished hereunder, exceed the price of the specific product or service which gives rise to the claim.


Warranty Exclusions: Products should be maintained properly by cleaning with mild soap, utilizing a high grade aluminum polish or chrome polish, and or a high quality carnuba wax depending upon finish type. Small flaws and/or marks do not constitute a flawed product. Corrosion defects due to salt spray in beach or snow areas, corrosive chemicals, improper care or cleaning are NOT COVERED by warranty.


The following are not covered by any warranty:
1. Any wheel or accessory which has been subjected to misuse, negligence, racing, improper installation, collision or damage from wheel weights.
2. Damage to the surface finish of the wheel or accessory as a result of stone chips or similar road hazard.
3. Damage to the surface finish of the wheel or accessory as a result of the use of polish, abrasives or rubbing compound or the use of acid based cleaners.
4. Any wheel which is installed without proper Thomason Performance accessories or installed on a vehicle other then what it was designed.
5. Any wheel or accessory that has been repaired or altered by a party other than Thomason Performance.
6. Corrosion or defects not resulting from manufacturing defects in workmanship or material.
7. Damage due to off-road or unlawful operation.
8. Labor and paint costs incurred by Thomason Performance in connection with any warranty claim.
9. Storage fees incurred in connection with any warranty claim.
10. Shipping or transportation costs incurred in connection with any warranty claim
11. Utilizing a repair facility not familiar in the practice of installing CUSTOM motorcycle wheels and or accessories.

Custom wheels may or may not require the use of different size spacers in order to center the wheel and accessories correctly. It is in your best interest to find a qualified motorcycle shop that is familiar in working with CUSTOM motorcycle wheels, and has the proper equipment required to manufacture spacers, etc; as needed. REFUNDS WILL NOT BE GRANTED due to minor fitment issues.


Warranty Service Contact Thomason Performance at (603)661-4984 in regards to warranty claims. A claim number will be issued, and this claim number must be visible on the outside of the package.

Send parts to us at the address below, with a description of the problem. You must prepay all shipping costs. Wheels will not be accepted with tires, rotors, sprockets or pulleys mounted unless Thomason Performance mounted and/or assembled such items. Thomason Performance is not responsible for parts lost or stolen in transit. You are encouraged to ship the parts via safest means possible, with receipt confirmation, and insurance if warranted.We will make every effort to ship replacement parts in a timely fashion, however, please be aware delays may sometimes occur due to cost incurred beyond the original cost of the part.

Warranty Limitations All Warranties are nontransferable, and are limited to or through the ORIGINAL RETAIL PURCHASER of the product(s) ONLY. "Date of invoice" for any Thomason Performance warranty refers the date on which the product(s) was purchased from Thomason Performance regardless of whether the product(s) was purchased by a retail user, or a dealer or wholesaler. Under no circumstance will any warranty expiration date be extended, unless agreed to by Thomason Performance in writing. Repair or replacement of the product by Thomason Performance is your sole and exclusive remedy. We are not responsible for incidental or consequential damages. Implied warranties, including those of fitness for a particular purpose and merchantability, are limited in duration to the one (1) year term of this express warranty. there are no express or implied warranties beyond those set forth in this document. Thomason Performance reserves the right to investigate all warranty claims.

Incorrect, damaged, or missing item must be reported within 72 hours of the time the product are received. You mount it you bought it. No exchanges will be accepted after 30 days from invoice date on chrome plated components. All other components will be limited to 90 days from the invoice date.
